In June 2017, our clients were arrested for their alleged involvement in the mobile phone mega-fraud known as Operation Rikati—an investigation carried out by the Central Operative Unit (UCO) of the Civil Guard, which uncovered a supposed multimillion-euro scam affecting thousands of mobile phone users.
The fraud was allegedly committed through apps that made automatic calls to premium-rate numbers or sent premium SMS messages.
Due to their alleged involvement, our clients were charged with a continuous offense of fraud in the form of a mass crime.
During the investigation—which included statements from the defendants and numerous witnesses—SMK Lawyers submitted a comprehensive forensic IT report to the court in defense of our clients.
We were able to prove that, contrary to the claims made by the Civil Guard, the events under investigation did not constitute a criminal offense. As a result, Investigating Court No. 5 of Mollet del Vallès issued a ruling dismissing the case.
